At Marbella 360 we are about to explain, briefly, the process to follow in order to be entitled to rent a dwelling under the existing legal framework in Andalucía after the last change in the legislation.
Up to the introduction of this normative changes, to be entitled to rent a dwelling in the Short Term Rental basis, it was compulsory to register in the Registro de Apartamentos Turísticos de Andalucía (Andalusian Touristic Apartment Registry), this is done through a procedure we explain hereunder. But after the mentioned change in the legislation, this change done on a nationwide basis, it is stated that to be entitle to rent on a short term Rental basis it is compulsory to obtain the Número de Registro para el Alquiler de Vivienda Turística (Touristic Dwelling Rental Unique Number), this procedure, also explained hereunder, is done through the National Land and Commerce Registrar Association.
To start the process.
Firstly, you will need to register your property for short term rental in the Registro de Apartamentos Turísticos de Andalucía (Andalusian Touristic Apartment Registry). To achieve so, you will need to fill a Statement of Responsibility, that is done filling out a form that can be downloaded from the Junta de Andalucía website. Once the Junta de Andalucía (regional authority) answers, you will be able to carry on with the process. The answer (formal inclusion of the dwelling in the registry) will include a Dwelling Record Number, that will need to be attached in the next step to take, the registration of the property in the National Land and Commerce Registrar Association to obtain the Touristic Dwelling Rental Unique Number.
This new stage shall be completed through the National Land and Commerce Registrar Association website, click here to download a guide document to apply for the Touristic Dwelling Rental Unique Number. Bear in mind that to complete this stage you will need to have available the following documentation:
- 1.- Cadastral Reference and exact address of the dwelling.
- 2.- You will need to state whether if the aim is to rent the whole premises of some rooms.
- 3.- Number of guests allowed to occupy the dwelling.
- 4.- Complies with the stablished requirements of the regional authority where the property is located.

The moment both procedures (the dwelling is listed in the Andalusian Touristic Apartment Registry and holds the Touristic Dwelling Rental Unique Number), you will need to sign up in the “Hospedajes App” belonging to the internal Affairs Ministry. Just as it happens in any Hotel, the proprietors/managers of the Touristic Dwellings are bound to inform, through the mentioned App, of the identity of the guests over 16 years old.
